S106 contribution triggers

A standard set of Section 106 education contribution triggers have been agreed with our local planning authorities (LPAs). These triggers provide consistency for developers when agreeing education contribution payments. It shall be the responsibility of the LPA granting the approval to inform us as soon as any trigger points for payments have been reached.

The standard S106 education contribution triggers are:

Number of dwellingsPayment
Under 50 1 payment on or before commencement
51-150

2 payments:

  • 50% on commencement of the development 
  • 50% on commencement of 50% of the development
151+

3 payments:

  • 30% on commencement of the development 
  • 30% on commencement of 30% of dwellings (i.e. for 500 dwellings it would be the 151st dwelling) 
  • 40% on commencement of 60% of dwellings (i.e. for 500 dwellings it would be the 300th dwelling)

 


 

S106 standardised templates

The Staffordshire LPA, including the county council, have come together to produce a standardised template for Section 106 agreements across the county relating to planning applications made to the Staffordshire district or borough councils.

We have committed to publicising this standardised template up front, so applicants are clear what documentation they are required to complete as part of the application process. This will reduce delays and costs for applicants and simplify the planning process.

The standard template has optional schedules which will be applied according to the nature of any proposed development.

We do not envisage entering into significant dialogue with applicants regarding amendments to the standard template other than removing references which are plainly not applicable, as the template has been agreed by the county council and the Staffordshire district and borough council planning authorities.
