Road Traffic Regulation Act 1984

(Prohibition of Motor Vehicles) Order 2024

  1. Staffordshire County Council on 27 August 2024 made a Traffic Regulation Order under the Road Traffic Regulation Act 1984 to prevent a motorised vehicle from being driven along Swan Rake and Limers Rake, Hollinsclough.
  2. Documents may be examined during office hours at 1 Staffordshire Place, Tipping Street, Stafford, ST16 2DH and during opening hours at Leek Library, Nicholson Institute, Stockwell Street, Leek.
  3. Persons questioning the validity or provisions of the Order on the grounds that such powers are not conferred by the Act, or that any requirement or instrument made under the Act has not been complied with, may within 6 weeks from the date the Order was made apply to the High Court.
  4. The Order will commence on 02 September 2024

(Prohibition of Motor Vehicles) Order 2024

The Staffordshire County Council ("the Council") in exercise of its powers under Sections 1(1), 2(1) to (3) and 3(2) of the Road Traffic Regulation Act, 1984 ("the Act") and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act hereby makes the following Order:-

  1. No person shall cause any motorised vehicle to proceed at any time on any day in the lengths of highway specified in the Schedule to this Order.
  2. Nothing in Article 1 shall render it unlawful to cause or permit any motorised vehicle to proceed in the lengths of highway specified in the Schedule to this Order if the vehicle is being used for the maintenance, improvement or reconstruction of the highway; the laying, erection, alteration or repair in, or in land adjacent to the said length of highway, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telegraphic line as defined in paragraph 1(1) of the Telecommunications Code contained in Schedule 2 to the Telecommunications Act 1984; in the service of a local authority or a water undertaker or sewerage undertaker or the Environment Agency in pursuance of statutory powers or duties; or for any resource mains and also any flood defence works or land drainage works; or for police, fire brigade or ambulance purposes or for access to premises situated on or adjacent to the said lengths of highway. 
  3. This Order shall come into operation on 02 September 2024 and may be cited as the Staffordshire County Council (Swan Lake and Limers Rake, Hollinsclough) (Prohibition of Motorised Vehicles) Order 2024.

Schedule

Swan Rake, Hollinsclough – from its junction with New Road for a distance of approximately 425 metres in a westerly and south westerly direction to its junction with FP NO. 30 Hollinsclough.

Limers Rake, Hollinsclough – from its junction with FP NO. 22 Hollinsclough for a distance of approximately 585 metres in a north easterly, northerly and north westerly direction to its junction with Swan Rake.
