Nature of works

Developer who wishes to construct new roads and/or needs to create an access or modify the highway as a result of development. 

Are the works involving the construction of new roads to be adopted?

Yes: New Roads Agreement (section 38)

If you answer yes to any of the below, please complete the major works agreement (section 278 or section 111 and 130)

  • Are there significant junction works involved i.e. new traffic signals, a roundabout, puffin crossings, etc.?
  • Is the value of the works over £20,000?
  • Is there land transfer required?
  • Is a permanent traffic regulation order required?
  • Is the proposal affecting the traffic sensitive network?
  • Are there any alterations required to permanent highway structures?
  • Are there any other works in the vicinity that may have an influence on this project?

If you have answered no to all of the above, please complete the minor works agreement (section 111 and 130). 

Definitions

New roads - construction of new estate roads (residential / commercial) which requires a section 38 agreement under the Highways Act 1980. This is separate to a major or minor works agreement. 

Value of works - Estimated construction value of works (exc. costs to third parties e.g. utility diversions).
